BrewArt encourage BrewArtists to submit comments, photos, and videos. We will remove any content that is inappropriate, offensive or contains external links for the purpose of commercial promotion.
Please understand that comments posted to this Site do not necessarily represent the opinions of BrewArt.
The Community Site forms part of the overall Site. These Community Rules should be read in conjunction with the Website Use Terms (made available on this Site) which also apply more generally to your use of this Community Site (as part of the Site). Capitalised words which are not defined in these Community Rules have the meanings given to such expressions in the Website Use Terms.
If you do not agree with any part of these Community Rules you should immediately discontinue your use of this Site.
All comments, visuals, videos, messages, data, information, text, music, sound, photos, graphics, code, Communicated Materials and other types of material posted by BrewArtists (Content) on this Community Site do not necessarily reflect the opinions or ideals of BrewArt, its employees or affiliates. BrewArt:
· does not represent or warrant the accuracy of any statement or product claims; and
· does not endorse any opinions expressed on this Site.
You must not submit to or post on the Site, and we may at any time remove, any Content that we consider:
a) does or could result in publishing, posting, distributing or disseminating any material or information which is false, unlawful, misleading, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, or advocates harassment of another person, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent or is otherwise objectionable;;
b) does or may defame or is negative towards BrewArt competitors;
c) does not comply with (or does, could or is likely to result in BrewArt failing to comply with or incurring liability in connection with) any applicable advertising or industry code including, without limitation, the ABAC Responsible Alcohol Marketing Code published as part of the Alcohol Beverages Advertising Code Scheme, the Australian Association of National Advertisers’ (AANA) Code of Ethics, the Australian Advertising Standard Bureau guidelines and any other Applicable Laws;
d) does or could result in uploading or attaching files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents;
e) does or could result in uploading or attaching files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer or which, directly or indirectly, is harmful or disabling or which assists in or enables unauthorised access to or corruption of data;
f) does or could result in the deletion of any author attributions, legal notices or proprietary designations or labels in any Content that is uploaded;
g) does or could result in falsification of the origin or source of software or other material contained in a Content that is uploaded;
h) appears to be advertising, commercial in nature or contains unsolicited promotions, mass mailings, junk mail, political campaigning, contests, raffles, or offers;
i) violates any Applicable Laws or would give rise to criminal or civil liability, violate the rights of any party in any country of the world, or that would otherwise create liability under any Applicable Laws;
j) is unrelated to the topic of the forum in which such Content is posted;
k) presents an immature, unbalanced or irresponsible approach to the consumption of alcohol beverages;
l) encourages or promotes offensive behaviour, misuse or abuse of or excessive consumption of alcohol beverages;
n) encourages underage drinking or has a strong or evident appeal to children or adolescents;
o) suggests that the consumption or presence of alcohol beverages can change a mood or environment;
p) shows the consumption or presence of alcohol beverages as leading to personal, business, social, sporting, sexual or other success;
q) implies or suggests that an alcohol beverage shown as part of a celebration was a cause of the success or achievement;
r) suggests that the consumption of alcohol beverages offers any therapeutic benefit or is a necessary aid to relaxation;
s) associates consumption of alcohol beverages with operating a motor vehicle, boat or aircraft or engaging in any sport or potentially hazardous activity;
t) challenges or dares people to drink or sample a particular alcohol beverage;
u) contains any inducement to prefer an alcohol beverage because of its higher alcohol content;
v) does not comply with community standards of taste and decency, particularly as to discrimination, vilification, objectification of people, violence, sex, sexuality, nudity, language, health and safety;
w) has images which include people that appear to be under 25 unless they are children and adolescents pictured in natural situations (e.g. family barbecue, licensed family restaurant) and where there is no implication they will consume or serve alcohol beverages;
x) brings the ABAC Scheme into disrepute; or
y) does or would result in a breach of the Website Use Terms.
Please note that as per the Australian Advertising Standards Bureau (ASB) guidelines, BrewArt may be held responsible for Content posted on this Site. We ask that you bear this in mind when posting, as BrewArt reserves the right to remove comments and content that may be deemed offensive, defamatory, or in any other way in breach of these Community Rules, the Website Use Terms or the relevant ASB guidelines. BrewArt also reserves the right to edit any post, Community Site member profile and/or cancel Community Site memberships if you are in breach of any of the foregoing. BrewArt may or may not give a Community Site member a warning.
Nothing in these Community Rules limits BrewArt’s rights under any Applicable Law or otherwise.
The Community Site will ordinarily be monitored from the hours of 9am to 5pm ACST from Monday to Friday excluding public holidays. Posts and responses to user generated posts will be made during these times. BrewArt will aim to respond to user generated posts within 24 hours of the posting. Should you wish to make BrewArt aware of any Content deemed unacceptable you can click on the “Report post” link located at the bottom of each post.
Amendment to the Community Rules
We reserve the right to amend these Community Rules and any content or feature of this Site from time to time without notice to you. Unless we state otherwise, any amendments shall be effective immediately upon notification on the Site.
You acknowledge and agree that these Community Rules are governed by, and shall be construed in accordance with, the laws of South Australia and the Commonwealth of Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of South Australia and the division of the Federal Court of Australia in that jurisdiction, and the courts of appeal from them. You may not object to the jurisdiction of any of those courts on the ground that it is an inconvenient forum or that it does not have jurisdiction.
If you fail to comply with the above Community Rules or the Website Use Terms, your rights to use this Site terminate immediately and you must destroy any and all copies of any Material you obtained from this Site.
